Terms of Service (利用規約)

Customers are requested to read these Terms of Service carefully before registering an account, placing an order, making payment, or continuing to use Suzuki's website and services. These Terms, together with the Shipping Policy, Return and Refund Policy, Privacy Policy, and Disclosure under the Act on Specified Commercial Transactions, constitute the complete agreement between the Customer and Suzuki.

Article 1. Service Provider and Scope of Application

1.1 Service Provider

The website and the services described in these Terms are operated by:

In these Terms, "Suzuki" is used to refer to SUZUKI & CO., LTD., the legal entity that owns and operates the website and the services described below.

1.2 What Suzuki Does

Suzuki is a business engaged in pre-owned goods in Japan. Suzuki purchases pre-owned goods in Japan, directly owns them, inspects them, evaluates their condition, stores them at the Suzuki warehouse, and resells them to Customers in Japan as well as Customers overseas through this website and other sales channels.

For all Products offered for sale on the website, Suzuki is the seller. Suzuki owns the goods before offering them for sale, is responsible for the Stated Condition information, and directly packs and ships the goods from its own warehouse.

1.3 What Suzuki Does Not Do

Suzuki does not purchase or place orders on behalf of Customers from e-commerce marketplaces, stores, or third-party sellers at the Customer's request. Suzuki does not provide shipping, consolidation, or forwarding services for goods not sold by Suzuki. Suzuki does not operate a marketplace for third-party sellers and does not sell under a dropshipping model.

1.4 Applicable Persons

These Terms apply to all individuals and organizations that access the website, register an account, place an order, or use any Suzuki service, whether in Japan or overseas.

1.5 Acceptance of the Terms

A Customer's registration of an account, placement of an order, payment, or continued use of the website shall be deemed to mean that the Customer has read, understood, and agreed to all of these Terms. If the Customer does not agree to any content, the Customer is requested not to use the services.

Article 2. Definitions

  1. Suzuki: SUZUKI & CO., LTD. (株式会社鈴木商会), the Japanese legal entity that owns and operates the website.
  2. Customer: an individual or organization that registers an account, places an order, or uses Suzuki's services.
  3. Website: the website at https://szk1982.com and other platforms operated by Suzuki.
  4. Product: pre-owned goods owned and offered for sale by Suzuki on the website.
  5. Stated Condition: the written description, images, and condition grade that Suzuki publishes for each Product at the time it is offered for sale.
  6. Order: a request to purchase one or more Products sent by the Customer through the website.
  7. Order Confirmation: a notice from Suzuki stating that the Order has been accepted after payment has been successfully recorded.
  8. Suzuki Warehouse: Suzuki's warehouse in Japan, where goods are stored, inspected, packed, and dispatched.
  9. Suzuki Balance: internal credit recorded in the Customer's account, used for payment on the website (see Article 9).
  10. Related Policies: the Shipping Policy, Return and Refund Policy, Privacy Policy, Disclosure under the Act on Specified Commercial Transactions, and guidelines published on the website.

Article 3. Conditions for Use of Services

  1. Customers must be at least 18 years old or have reached the age of majority under the laws of their place of residence. Minors may use the services only with the consent and supervision of a parent or legal guardian.
  2. Customers must have full legal capacity to enter into a sales contract.
  3. Customers are responsible for ensuring that the purchase and importation of Products is lawful in the country or territory of delivery.
  4. Suzuki has the right to refuse to provide services to any Customer if there are reasonable grounds to believe that such provision would violate laws, these Terms, or create risk for Suzuki.

Article 4. Customer Account

4.1 Account Registration

Customers must provide complete, truthful, and accurate information as required when registering. Suzuki has the right to request additional information or identity verification documents when necessary to ensure transaction security, comply with laws, or meet the requirements of payment partners.

4.2 Account Security

Customers are responsible for keeping their login information confidential, are responsible for all activities arising from their account, and must immediately notify Suzuki upon discovering unauthorized access to or use of their account.

4.3 Updating Information

Customers are responsible for promptly updating their information when there is any change to their full name, delivery address, telephone number, email, payment information, or other information affecting delivery. Suzuki is not responsible for damage arising from incorrect or outdated information.

4.4 Suspension or Termination of Account

Suzuki has the right to suspend or terminate an account showing signs of:

  • Providing untruthful information;
  • Using the account unlawfully;
  • Payment fraud, abuse of return policies, or untruthful complaints;
  • Causing damage to Suzuki, other Customers, or third parties;
  • Violating these Terms or the Related Policies.

Before terminating an account, Suzuki may request the Customer to provide an explanation to the extent appropriate for each case. Orders confirmed before the time of termination will continue to be processed in accordance with these Terms, except where the Order is directly related to the violating conduct.

4.5 Account Deletion

Customers may request account deletion in accordance with the instructions on the website or via the support email. Account deletion does not eliminate any outstanding payment obligations and does not affect Orders being processed. Data is processed in accordance with the Privacy Policy.

Article 5. Pre-Owned Products and Stated Condition

5.1 Nature of Products

All Products offered for sale on the website are pre-owned goods, unless expressly stated otherwise. Pre-owned Products may have signs of use, wear and tear, discoloration, scratches, odors, missing accessories, or differences compared with new products, consistent with the Stated Condition. These signs are not considered defects in the Product.

5.2 Each Product Is an Individual Item

Each Product is inspected by Suzuki and assigned its own item management code. Two Products of the same brand and model may have completely different conditions, accessories, and sale prices. The disclosed information applies only to the exact Product bearing that code. Each Product is a one-of-a-kind item.

5.3 Condition Information

For each Product, Suzuki discloses:

  • Actual photographs of that Product itself;
  • A written condition description, including significant defects that Suzuki noticed during inspection;
  • The condition grade according to the scale in Article 5.4;
  • A list of included accessories (if any);
  • Other information such as size, year of manufacture, and origin when Suzuki can determine it.

Suzuki inspects Products with the reasonable care of a business engaged in pre-owned goods, but cannot guarantee that every minor defect will be detected. Actual colors may differ slightly from the images due to shooting conditions and display screens. If there is a conflict between images and the written description, the written description prevails.

5.4 Condition Grade Scale

5.5 No Manufacturer's Warranty

Pre-owned Products do not come with a manufacturer's warranty, unless Suzuki clearly states the remaining warranty period and accompanying documents. Suzuki is responsible only for ensuring that the Product conforms to the Stated Condition in accordance with the Return and Refund Policy.

5.6 Authenticity

Suzuki checks the authenticity of branded Products within the scope of its capabilities and internal inspection standards. If a Product is determined to be counterfeit, the Customer will receive a full refund in accordance with the Return and Refund Policy.

5.7 Products with Special Requirements

Some Products may be subject to restrictions regarding export, import, the buyer's age, or licenses, such as antiques, Products containing animal parts, or devices using lithium batteries. Suzuki states restrictions clearly when known and has the right to refuse to deliver Products to addresses that are not eligible to receive them.

Article 6. Ordering and Formation of Transactions

6.1 Placing an Order

Customers select the Product, delivery address, shipping method, payment method, and submit the Order through the website. Before submission, Customers can view the total amount payable, including the Product price, shipping fee, and other charges (if any). Submission of an Order is the Customer's offer to purchase and is not yet an established contract.

6.2 Order Confirmation

The sales contract is formed when Suzuki records successful payment and sends an Order Confirmation. Because each Product is a one-of-a-kind item, the Product is reserved for the Customer only from this time.

If two Customers order the same Product, the Product is allocated to the Customer whose payment is recorded first. The payment of the remaining Customer will be fully refunded in accordance with the Return and Refund Policy.

6.3 Price Offers

For some Products, the website may allow Customers to submit a proposed price. A price offer does not reserve the item. Suzuki has the right to accept, reject, or propose a different price. When Suzuki accepts, the Customer must complete payment within the notified period; otherwise the offer expires.

6.4 Suzuki's Right to Refuse or Cancel Orders

Suzuki has the right to refuse or cancel an Order, even after confirmation, in the following cases:

  • The Product is no longer available, is damaged, or is lost before delivery;
  • A significant error in the price or Product description is discovered;
  • The Product may not be exported or imported to the delivery address;
  • There are signs of fraud, abnormal payment, or untruthful information;
  • The Customer's identity or payment cannot be verified when necessary.

In these cases, Suzuki will notify the Customer and fully refund the amount paid for that Order.

6.5 Pricing Errors

If a Product is listed at an incorrect price due to input error or system error and the incorrect price is clearly and unusually low compared with the actual value, Suzuki has the right to cancel the Order and refund the payment even after confirmation.

6.6 Order Cancellation at the Customer's Request

The conditions, time limits, and method of cancellation are provided in the Return and Refund Policy.

Article 7. Sale Prices, Taxes, and Fees

7.1 Listed Currency

Product prices are listed in Japanese yen (JPY). The website may display converted prices in another currency for reference. The converted amount is for reference only, unless the website clearly states that it is the amount to be collected.

7.2 Japanese Consumption Tax

For Orders delivered within Japan, the listed price includes Japanese consumption tax. For Orders delivered overseas, Products are exported as exempt from consumption tax; prices displayed for delivery addresses outside Japan do not include consumption tax.

7.3 Shipping Fees

Shipping fees are calculated according to size, weight, delivery address, and shipping method, and are displayed before the Customer submits the Order. Details are provided in the Shipping Policy.

7.4 Import Taxes and Fees

For Orders delivered outside Japan, import duties, value-added tax, customs clearance fees, and fees collected by customs authorities or carriers in the receiving country are borne by the Customer and are not included in the amount paid to Suzuki.

7.5 Price Changes

Suzuki has the right to change the price of unsold Products at any time. The price applicable to an Order is the price at the time the Customer submits the Order and is recorded in the Order Confirmation.

Article 8. Payment

8.1 Payment Methods

Suzuki accepts the payment methods displayed at checkout, including credit or debit cards through the Stripe payment gateway, bank transfer in Japan, and Suzuki Balance. Available methods may vary by country and according to Suzuki's policies from time to time.

8.2 Payment Confirmation

Orders are processed only after Suzuki records successful payment. For bank transfers, the Product is held for 3 days from the time of order; if payment is not received after that period, the Order is canceled and the Product is made available for sale again.

8.3 Payment Currency and Exchange Rate

When paying in a currency other than Japanese yen, the amount is collected at the exchange rate displayed at the time the Customer confirms the Order. This exchange rate may include conversion costs and may differ from bank exchange rates. The Customer's card-issuing bank may charge additional international transaction fees beyond Suzuki's control.

8.4 Payment Security

Suzuki does not store Customers' full card numbers. Card processing is carried out by licensed payment partners. Suzuki has the right to request additional verification for transactions showing unusual signs and to hold the Order until verification is completed.

8.5 Documents

Suzuki provides Order confirmations and payment documents by email or in the Customer's account. Requests for invoices in a separate format are handled in accordance with the instructions on the website.

Article 9. Suzuki Balance

  1. Suzuki Balance is internal credit recorded in the Customer's account, arising from amounts topped up by the Customer, refunds, or valid adjustments, and used to pay for Products, shipping fees, and valid charges arising on the website. Balance is not a bank account, electronic wallet, or independent payment instrument and does not accrue interest.
  2. Balance may be used only on Suzuki's website, may not be transferred to other users, and is not deleted due to the absence of transactions.
  3. Customers may request withdrawal of unused topped-up amounts according to the withdrawal process on the website. Refunds of other amounts are carried out in accordance with the Return and Refund Policy.

Article 10. Shipping

Suzuki packs and ships goods from the Suzuki Warehouse to the address provided by the Customer, within Japan or overseas, through carriers selected by Suzuki. Processing time, methods, fees, transfer of risk, country restrictions, and handling of delivery failure are provided in the Shipping Policy, which is an integral part of these Terms.

Article 11. Order Cancellation, Returns, and Refunds

The conditions for order cancellation, returns, refunds, and handling when a Product differs from the Stated Condition are provided in the Return and Refund Policy, which is an integral part of these Terms. Because pre-owned Products are one-of-a-kind items, Suzuki does not accept exchanges or returns due to change of mind or due to signs of use that were stated in the Stated Condition.

Article 12. Complaints

  1. Customers must submit complaints regarding Products within 7 days from the date on which the carrier records successful delivery, through the Customer account or support email.
  2. The complaint must include the Order number, images or videos showing the issue, images of the external packaging if related to damage during shipping, and a description of the incident.
  3. Suzuki verifies the information, checks inspection data and images before dispatch from the warehouse, works with the carrier if necessary, and responds within 3 business days after receiving the complete file. The time required for full resolution depends on the nature of the matter and the cooperation of the parties.

Article 13. Intellectual Property and Website Content

  1. All content on the website, including Product images taken by Suzuki, descriptions, logos, interface, source code, and data, is owned by Suzuki or licensors to Suzuki.
  2. Customers may not copy or reuse Product images or descriptions for commercial purposes without Suzuki's written consent.
  3. Manufacturers' trademarks displayed on Products belong to their respective owners. Suzuki is a reseller of pre-owned goods and is not an authorized dealer of those brands, unless expressly stated.
  4. Content that Customers submit to the website, such as reviews, comments, and questions, may be used by Suzuki to operate and improve the services. Customers warrant that the content they submit does not violate the rights of third parties.

Article 14. Prohibited Conduct and Indemnification

14.1 Prohibited Conduct

Customers must not:

  • Provide false information or use a card or payment account that they are not lawfully entitled to use;
  • Place Orders without intending to pay, place bulk Orders to reserve items, or cause disruption;
  • Abuse return policies, make untruthful complaints, or initiate an unfounded chargeback;
  • Use automated tools to collect data, place Orders, or interfere with the system;
  • Intrude into, sabotage, overload, or attempt to bypass the website's security measures;
  • Purchase Products for use for unlawful purposes in Japan or the receiving country;
  • Insult or threaten Suzuki staff or other Customers.

14.2 Indemnification

A Customer who violates these Terms or the law and thereby causes damage to Suzuki or a third party, including processing costs, reasonable legal costs, and penalties imposed by competent authorities, is responsible for indemnifying Suzuki for those amounts.

Article 15. Limitation of Liability

  1. Suzuki's liability for each Order is limited to the total amount the Customer paid for that Order, except where otherwise required by law or where damage is caused by Suzuki's intentional misconduct or gross negligence.
  2. Suzuki is not responsible for indirect damage, loss of profits, loss of business opportunities, or damage arising from improper use of Products.
  3. Suzuki is not responsible for damage arising from incorrect information provided by the Customer, natural wear and tear or inherent characteristics of pre-owned Products, decisions of customs authorities, delays by carriers beyond reasonable control, or force majeure events.
  4. The website is provided as-is. Suzuki endeavors to maintain stable operation of the website but does not guarantee that the website will be uninterrupted or error-free.
  5. Where the consumer protection laws of the Customer's place of residence provide rights that cannot be restricted by agreement, those rights are preserved.

Article 16. Force Majeure

Suzuki is not responsible for delay or inability to perform obligations due to events beyond reasonable control, including but not limited to: natural disasters, earthquakes, fires, war, strikes, epidemics, system or network failures, decisions of government authorities, changes in import/export policies, or disruptions of carriers or payment partners. When the event ends, Suzuki will continue to perform its obligations to the extent possible. If the event continues and makes delivery of the Order impossible, Suzuki will refund the Customer.

Article 17. Information Privacy and Verification

  1. Suzuki collects and processes personal information in accordance with the Privacy Policy.
  2. In some cases, Suzuki has the right to request that the Customer provide identity documents, confirmation of payment method, or other documents to verify the transaction, prevent fraud, comply with laws, or meet the requirements of payment partners. Refusal to provide such documents may result in suspension or cancellation of the Order.

Article 18. Amendment of Terms

Suzuki has the right to amend these Terms and the Related Policies to conform to business operations, laws, requirements of payment or shipping partners, or to improve the services. The new version will be published on the website together with the effective date. For important changes, Suzuki will notify Customers by email or by notice on the website before they take effect. Orders confirmed before the effective date will be processed according to the version applicable at the time of confirmation.

Article 19. Governing Law and Dispute Resolution

  1. These Terms are governed by and interpreted in accordance with the laws of Japan.
  2. In the event of a dispute, the parties will give priority to resolution through good-faith negotiation via Suzuki's support channels.
  3. If no agreement is reached, the dispute will be submitted to the Tokyo District Court (東京地方裁判所) as the agreed court with jurisdiction at the first instance, except where the consumer protection laws of the Customer's place of residence mandatorily provide otherwise.

Article 20. General Provisions

  1. Language: These Terms are published in multiple languages. If there is any difference between versions, the Japanese version prevails.
  2. Severability: if any provision is determined to be invalid, the remaining provisions remain effective.
  3. No Waiver: Suzuki's failure to exercise any right is not considered a waiver of that right.
  4. Assignment: Customers may not assign their rights and obligations under these Terms to a third party without Suzuki's consent.
  5. Notices: Suzuki contacts Customers via the registered email, notices in the account, or on the website.
  6. Disclosure under the Act on Specified Commercial Transactions (特定商取引法): published on a separate page on the website and forms part of these Terms.
